Fort Myers Beach Mayor Ray Murphy announces lawsuit dropped over Margaritaville

Fort Myers Beach Mayor Ray Murphy announced today that the latest lawsuit over Margaritaville has been dropped after his meeting with the parties."From what I understand, it's going to be a voluntary dismissal without prejudice. It's over," Murphy said. "It's time to move on."The announcement follows a tense meeting at the Town of Fort Myers Beach Council in which supporters of Margaritaville, including several local business owners and the Fort Myers Beach Chamber of Commerce, called for the lawsuit to be dropped. Sheriff's Office to open outreach center on Fort Myers Beach         

The site of a former realty office on property owned by TPI on Estero Boulevard across from Crescent Beach Park is being turned into a community outreach center for the Lee County Sheriff's Office. Several local businesses have joined TPI, the development company behind Margaritaville, in transforming the building into an outreach center for the Sheriff's Office. Margaritaville – FMB

Update: On July 9, 2020 Chris Patton filed her third lawsuit against the Town of Fort Myers Beach seeking to stop the Margaritaville – FMB Resort. This one challenges the constitutionality of the use of “exceptional circumstances” in the town’s code [Section 34-1803(a)(2)].  “Denied.” That’s the entire decision from the Florida Second District Court of Appeals in the case of Chris Patton vs. Town of Fort Myers Beach and TPI-FMB, issued July 8, 2020. No opinion, no equivocation, just “Denied.” The decision indicated that all three appeals court judges – Northcutt, Kelly and Atkinson agreed with the decision. Tom Torgerson, representing TPI Hospitality, was “pretty darn excited” about the decision on Wednesday morning and immediately wanted to thank the Fort Myers Beach community for its ongoing support over the almost two-year-long “ridiculous legal challenge.”

South End Boardwalk

The owners of Texas Hold ‘Em LLC and Squeeze Me Inn LLC properties at 8150 & 8170 Estero Boulevard have sought permission to construct a dune walkover boardwalk adjacent to the Little Estero Island Critical Wildlife Area (CWA) from their properties to the beach for the past four years. As the process moved along, the owners received a Department of Environmental Protection (DEP) permit in 2016; a 2017 Florida Fish & Wildlife Conservation Commission permit; and in 2018 a DEP construction permit. In October 2019, the Town’s LPA approved the structure with conditions by a unanimous vote, though Town staff recommended against it, leaving only Council permission needed. Fort Myers Beach has several significant projects currently on the drawing board, under construction, or in litigation that – prior to the COVID-19 economic downturn – The Island Sand Paper planned to see through to their conclusions and share with readers. Now in our final issue, here is a brief recap of what’s happening with eight major projects and what their immediate future may hold. Full article and resource

Hurricane Prep, Know Your Zone

Evacuation zones are labeled A to E, with A being the most susceptible to storm surge and wind damage. As a storm approaches, the Lee County Emergency Operations Center, will issue evacuation orders in phases, with the zones most at risk being first, often while the skies are still clear and the sun shining. Don’t let the clear skies fool you.

The areas closest to the Gulf in Lee County are in the A zone, including all the barrier islands: Fort Myers Beach, Sanibel, Captiva, Pine Island. You might be surprised to know that Evacuation Zone A also includes areas along the Caloosahatchee River upstream to nearly Alva. Zone A also extends all the way to U.S. 41 from College Parkway to Bonita Beach Road, where Zone A reaches all the way to I-75. Keep this in mind as you decide where to go when you evacuate. Storm surge flooding can easily overwash our island in a storm. Water comes up quickly, but recedes very slowly, often hiding road damage under flood waters. The water and the ground can be contaminated by chemicals and raw sewage. Power will be out for a long time. Tap water may be unsafe. Cell service will be patchy, if available at all. If you choose not to evacuate, you may not be able to leave after the storm due to storm damage. Full article and resource

3 Judge Panel Hears Patton Appeal

On Tuesday morning, lawyers for Island resident Chris Patton, the Town of Fort Myers Beach and TPI/Margaritaville presented oral arguments in front of the 2^nd District Court of Appeals (DCA) via a Zoom virtual meeting in the case of Patton vs. the Town of Fort Myers Beach regarding the approval of the TPI/Margaritaville Resort on May 21, 2018. The three judge DCA panel, composed of Judge Stevan T. Northcutt, Judge J. Andrew Atkins and Judge Patricia J. Kelly heard oral arguments from Ralf Brookes representing Chris Patton, Russell Schropp for TPI/Margaritaville and John Herin, Jr. for the Town of Fort Myers Beach.  Full article and resource

Restaurant Dining Returns to FMB

Four Owners Discuss Changes

On March 20, 2020, Florida Governor Ron DeSantis closed all restaurants for on-premises dining, limiting them to carryout and delivery service. Over six weeks later, on May 4, he allowed Florida restaurants to reopen for outdoor dining and 25% of indoor capacity, then expanded that to 50% capacity on May 18, with Lee County taking the additional step to allow establishments with outdoor dining options to temporarily expand those. The Governor’s ongoing restrictions on outdoor dining include required social distancing. Seating at bar counters in restaurants remains prohibited and bars, as defined by more than 50% of revenue from alcohol sales, remain closed by DeSantis’ Executive Orders. As Fort Myers Beach restaurants gradually continue the slow climb up from a near total shutdown, the Island Sand Paper spoke with four owners of local restaurants to hear about their experiences. Three Board Seats Up For Election

Those readers who have reluctantly switched to an e-reader over the past few months due to reduced access to hardcopy books will be thrilled to learn that the Fort Myers Beach Library will reopen on Monday, June 1! Library patrons have been able to reserve books and drive by to pick them up for a few weeks, but shelf surfers will now be able to browse to their heart’s content. The library will open at 50% capacity, with four computers available for public use. Computer time will be limited to 30 minutes and computers will be cleaned between users. The Living Room/periodical room, children’s play room and café will remain closed and there will be no puzzle table. The decision on whether to open Beachcomber Books, the Friends of the Library used book store, is pending.

Fort Myers Beach residents are no strangers to emergency preparations, living on a barrier island with an annual six-month hurricane season. With the COVID-19 pandemic, however, locals must prepare for a 14-day or longer quarantine, should they or someone they encounter contract it. Fort Myers Beach Executive Assistant Fire Chief of Life Safety & Support Services Ron Martin discussed what to have on-hand should you need to self-quarantine, and how these differ from hurricane precautions.

Park Welcome & Discovery Center

On Track for 2021 Opening

On Monday, March 23, Governor Ron DeSantis ordered the indefinite closure of all Florida State Parks, including Lovers Key State Park (LKSP) just off the southern tip of Fort Myers Beach, to assist in the fight against the coronavirus  COVID-19 international pandemic, under the Center for Disease Control guidelines to maximize social distancing and avoid gatherings of more than 10 people. While the Governor’s directive closed LKSP to the general public, one extremely important project continues! “The Governor’s action did not stop the construction of our long-awaited Welcome & Discovery Center (WDC),” reported LKSP Manager Katie Moses! “We are installing the ‘Mangrove’ pilings right now; we call them that because they resemble mangroves for an artsy look to the base of the building. Once these are in place, construction crews will start on the actual form of the building. At that point, we will begin the framing for the elevated floor and then the walls, as well as the electrical and plumbing elements. The preliminary underground utilities are in place, with work yet to come with Florida Power & Light, along with water and sewer that will happen later this spring.”  Full story and article resource
